Facing a divorce or separation is very anxiety provoking to say the least and one question that most people have is "how much is this going to cost me" or "how can I afford this".  I have been practicing divorce or family law in Oakland County, Michigan for thirty years.  Most of the attorneys in the area do not like to quote how much they charge per hour on their website or blog posts for understandable reasons but I am doing so because I believe it is helpful to those faced with these serious problems.

How Much Does A Divorce Cost In Oakland County Michigan?

As stated above the eventual financial cost of a case is very hard to know until the case is actually finished.  Sometimes cases start smoothly and then unexpectedly things go sideways and expenses increase, sometimes a case starts off difficult then things settle down and the costs are less.  Finally, there are some cases where things go smoothly or the parties are in agreement and the cost is minimal comparatively.  In those cases, typically in my office they stay within the retainer I charge at the beginning of the case.

Most attorneys, like myself, charge an hourly rate based upon a sliding scale that takes into account the length of the marriage, whether there are minor children, the extent of the property or debt accumulated during the marriage, whether there is a business involved, severe personality issues, the height of conflict and other issues that can make the case more complicated or difficult and therefore expensive. 

My rate scale at this point in time is $300 to $375 dollars an hour and I typically ask for a retainer prior to the start of representation between $3,000 and $5,000.  This is not an additional fee, it is more like good faith money paid up-front.  I provide detailed monthly bills showing time/fees and any expenses, then I pay that bill out of the retainer money.  If the retainer gets used up, then we ask that the client pay the bill monthly, if that is not possible then we discuss financing the outstanding balance and payments.  If the client is not able to pay the monthly bill in full, sometimes the attorney gets paid in full when the home has to get refinanced or sold in order to divide the equity, other times there are cash transfers to equalize out the property between the parties at the end of the divorce from which attorneys get paid.
